This is the date the Buyer will physically take custody of the puppy. *SECTION 1 - SIZE, COLOR, AND FEATURES *- Breeder makes no warranty as to the size, features, or color of the puppy when grown.SECTION 2 - VET CHECKUP *- The puppy must be examined by a licensed veterinarian of the buyers choice and at their expense within 3 business days. Failure to have the puppy examined within 3 business days by a licensed veterinarian will render this warranty VOID. If the buyers veterinarian finds a life threatening, non-treatable, congenital defect (limited to the heart, liver, lungs, and kidneys only) the breeder must be notified within 3 business days. A copy and proof of the vet exam recheck must be emailed to the breeder (amandah17@hotmail.com) the same day as the exam. Puppy is guaranteed until six (6) months of age against life threatening congenital defects (limited to the heart, liver, lungs, and kindeys only).SECTION 3 - NO REFUND *- UNDER NO CIRCUMSTANCES WILL THERE BE A CASH REFUND. If an exchange is necessary due to the above circumstances outlined in section 2, the buyer will be issued a replacement puppy of equal value as soon as one becomes available (within 9 months). If still living the original puppy must be returned at buyers expense. If the puppy dies a necropsy must be performed at the buyers expense by a state lab or university to determine cause of death. Necropsy report must state that the puppy died from a cogenital defect. No other causes will be covered.SECTION 4 - VETERINARIAN EXPENSES *-The breeder is not responsible and will not be required to reimburse any veterinarian expenses incurred after the buyer takes posession of the puppy.SECTION 5 - OTHER HEALTH ISSUES *- The warranty does NOT cover: adverse reactions to vaccines, diarrhea, dehydration, Parvo, Distemper, overbites, underbites, ears not standing, retained testicles, breeding ability, show quality, trachea issues, open fontanel, luxating patellas, Coccidia, Guardia, parasites, ear mites, ringworm, worms, HYPOGLYCEMIA, allergies, etc.SECTION 6 - FECAL EXAM *- The Breeder recommends having a repeat fecal exam done by the buyers veterinarian due to the unpredicatable nature of parasites and bacteria.SECTION 7 - NOT RESPONSIBLE *- Once said puppy leaves the Breeders home, they are not responsible for any infections, allergies, illnesses, or behavioral problems that may occur.SECTION 8 - WHO THIS IS APPLICABLE TO *- This warranty is only applicable to the buyer and is non-transferable.SECTION 9 - AKC *- Breeder is not responsible for any issues that may arise through AKC (if applicable) IE: other breeders pedigrees behind the puppy, DNA issues etc. No novelty DNA testing of any sort is covered. Example: EMBark for breed ID etc.SECTION 10 - COUNTY OF INITIATION AND FINALIZATION *- All sales are considered initiated and finalized in Bulloch County, Georgia.SECTION 11 -BREEDING RIGHTS (FULL AKC) *- AKC papers are only provided to the buyer if they are purchasing breeding rights also known as “Full AKC”. Even though Full AKC application may be provided, breeder does not guarantee breeding ability or dog/puppy being show quality. Dog/puppy is being represented as pet quality only. If you are not interested in breeding, no papers will be provided. The guarantee is void if the dog has been sold as a pet but has been bred either accidentally or intentionally to any dog including dogs owned by the buyer. The buyer is to be responsible in not letting an accidental breeding regarding the puppy in this contract to occur before paying A $10,000 breeding fee. A fine of $10,000 must be paid to the breeder in the event of an accidental or purposeful breeding of the puppy aforementioned and no AKC papers will be provided after the fee is paid. This fine must be paid within 30 days of the day of notice from the Breeder via text, email, or in writing. Failure to pay within the 30 days from notice - will result in legal recourse to be filed and carried out in the county where the buyer resides. The buyer agrees to pay Filing fee’s, serving fee’s, and attorney’s fees incurred when the suit is filed at the county courthouse.SECTION 12 - MUTUAL NON-DISPARAGEMENT *- The Buyer agrees not to make public negative statements or communications disparaging Harrington Yorkies the Breeder or its agents, products, members, directors or officers. Public communications also include electronic platforms. The Seller (Including its agents, members, directors and officers) agrees not to make public negative or disparaging statements or communications about the Buyer. This clause is not violated when statements and evidence is required in response to legal proceedings in which both parties have agreed to subject themselves to resolve a dispute outside the boundaries of this contract. Including, but not limited to, evidence supplied for court filings, depositions, and hearings.SECTION 13 - FINANCIAL RESPONSIBILITY FOR HEALTH CARE *- It is highly recommend by the Breeder to the Buyer to obtain health insurance on their puppy. We do this because veterinary costs can be high, especially to diagnose or treat an illness or for unexpected accidents. We also make this reccomendation because puppies have their immune systems very fresh and beginning to work on their own at 7-8 weeks old. They are susceptible to all types of viruses, parasites, and illness at this age. If you are seeking a diagnosis on your puppy to fulfill the health guarantee and get a replacement puppy, the health insurance may be able to cover some of those costs. Buyer is aware of this recommendation.SECTION 14 - FIRST RIGHT OF RETURN *- The BUYER hereby agrees that if at any time the BUYER cannot take proper care of the puppy, the BUYER will contact the BREEDER and the BREEDER will have the first choice to either: 1) take the PUPPY back (The Breeder will always accept the dog/puppy back at no cost to the Breeder), 2) assist the BUYER in finding a suitable home for the PUPPY, or 3) the BUYER may find a suitable home. The BUYER understands that if puppy/dog is retured to Breeder that no refund will be issued.SECTION 15 - AGREEMENT TO TERMS *- Buyer agrees by signing below, to all the terms of this agreement included in sections 1-14. This agreement by the Buyer and the Seller is a binding contract, and is the only expressed agreement between the buyer and the Seller. I understand that I (buyer) will assume any and all veterinarian cost and any other expenses that might be incurred in connection with my puppy and waive any cost or claim whatsoever against the Breeder and its owners. I understand that full price is due when puppy is picked up or before puppy is delivered for flight.
